Privacy Policy

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“General Data Protection Regulation” or “GDPR”), which has been fully applicable since 25 May 2018 in the Republic of Croatia and all EU Member States, as well as the Act on the Implementation of the General Data Protection Regulation (Official Gazette 42/18), and in accordance with the personal data protection framework of the Republic of Croatia, the European Union, and best European practices, NAVIS MARINE d.o.o., Trg žrtava fašizma 5, 10000 Zagreb, Republic of Croatia, OIB: 33673833361 (hereinafter: Navis Marine), as the data controller for users of this website, has adopted this Privacy Policy.

This Privacy Policy (“Policy”) explains how Navis Marine collects, uses, and manages your personal data available on or through the website: navis-marine.com.

Navis Marine is committed to protecting and respecting your privacy. Please read this Policy carefully to understand why and how we collect your personal data and how it will be used. In relation to the personal data we collect, Navis Marine acts as the data controller, meaning the entity that determines the purposes and means of processing personal data.

If you wish to contact Navis Marine regarding this Policy or your personal data, you may do so using the following contact information:

NAVIS MARINE d.o.o.

HOW AND WHEN DO WE COLLECT YOUR PERSONAL DATA?

We collect your personal data when it is necessary to fulfil your needs and requests, to provide our services, or for the purposes of our business operations. Primarily:

1. To ensure the proper functioning and security of the website navis-marine.com at the moment you access it, we will collect your IP address, which is also considered personal data. Situations in which we collect other data include, for example, the date and time of access to this website, information about the hardware, software, or internet browser you use, the operating system of your computer, the version of the application, and your language settings. We may collect information about your clicks and your access to the website navis-marine.com. In accordance with applicable regulations, apart from the necessary cookies required for the correct functioning of the website, we will request your consent for all other categories of cookies through a pop-up window.

2. When you contact us via the form provided on this website to send inquiries about our offers or to send general questions/messages, we will need to process your name, your email address, and the content of your inquiry/message in order to respond to your request.

3. When you contact the Data Protection Officer to exercise one of your rights under the GDPR, Navis Marine will need to process personal data such as your name and surname, your request, and your contact details, all for the purpose of responding to your request.

4. When you contact our office to request assistance or ask a question, in order for us to fulfil any of your other rights guaranteed by applicable regulations.

5. When you contact us via social media, we collect the data you have made available when submitting a request or inquiry, solely for the purpose of responding to your question or request.

6. If you wish to submit an open job application, we will process data such as your name, surname, age, academic title, profession, work experience, phone number, and other information contained in your open application.

7. If you wish to subscribe to our Newsletter, i.e., if you want to receive email updates about our latest news, events, and special offers, we will need to collect and process your email address. Please note that you may unsubscribe at any time (you can do so at the bottom of any email we send by simply clicking “Unsubscribe” or by sending a request to the Data Protection Officer). We will process your email address until you unsubscribe or no longer wish to receive the newsletter. The newsletter contains so-called tracking pixels. A tracking pixel is a miniature graphic element embedded in an email sent in HTML format, enabling storage and analysis through log files. This allows statistical analysis of marketing campaign performance. Through the tracking pixel, Navis Marine can see when and if an email has been opened by you as the recipient and which links you have clicked on. Personal data collected via tracking pixels in the newsletter is stored and analysed by Navis Marine, as the data controller, in order to optimize the newsletter-sending process and tailor future newsletter content to the interests of recipients.

8. If you visit our offices, please note that certain locations are under video surveillance. The personal data processed in such cases includes facial and body appearance, manner of movement, date and time of visit, and other visual information that may indirectly reveal personal characteristics about you as a visitor. Processing is carried out based on the legitimate interest of Navis Marine for the purpose of protecting the life and health of persons and the protection of property. The legitimate interest is assessed and documented in relation to the rights and freedoms of data subjects. At the latest upon entering an area covered by video surveillance, you will be clearly informed through a short notice (sticker), and a detailed notice on video surveillance processing is available on Navis Marine premises.

The above categories of personal data are collected either based on your consent (for example, the consent displayed upon visiting navis-marine.com regarding cookies, or when subscribing to our newsletter), legitimate interest (for example, use of the video surveillance system), compliance with legal obligations under the laws of the Republic of Croatia (for example, responding to your GDPR requests), or contractual necessity or steps taken at your request before entering into a contract (for example, sending us a message expressing interest in cooperation so that we may send you an offer).

If the processing is based on your consent, you have the right to withdraw that consent at any time. You must notify the data controller of the withdrawal at: [email protected] or at the address: Trg žrtava fašizma 5, 10000 Zagreb, with the note “For the Data Protection Officer.” Such withdrawal will not affect the lawfulness of processing based on consent before its withdrawal.

If processing is based on legitimate interest, Navis Marine has established procedures to assess whether such processing is appropriate for business needs and minimally intrusive. Such processing is carried out only when the interests of the data subject do not override the legitimate interests of Navis Marine. In such cases, the data subject always has the right to object to the processing.

Please note the mandatory scope of data we request from you. If you do not provide the information defined as mandatory in order for us to carry out the activity requested or expected by you, unfortunately, you will not be able to participate in that activity, as it cannot be technically executed without the required data.

WHAT DATA DO WE COLLECT DIRECTLY FROM YOU AND FOR WHAT PURPOSE?

The typical categories of data we collect include: your name and surname, contact details, and any other information you provide when filling out forms available on navis-marine.com, or when communicating with us via telephone or email.

We collect your personal data for the purpose of:

  • providing the requested service,
  • enabling the use of all services on the website navis-marine.com,
  • responding to your inquiry as efficiently as possible and processing your requests,
  • statistical data analysis,
  • improving the quality of content, functionality, and services.

WHAT PRIVACY RIGHTS DO YOU HAVE?

As a data subject, you have rights guaranteed by the General Data Protection Regulation (GDPR), which you may exercise in certain circumstances. You may request Navis Marine to:

      • request access to your personal data

You have the right to request confirmation as to whether your personal data is being processed, as well as to obtain access to that data and additional information regarding the purpose of processing, categories of data, recipients to whom the data has been disclosed, retention periods, and the rights available to you. You may contact us if you would like a copy of some or all of the personal data we hold about you.

      • request the correction of inaccurate data

We want your personal information to be accurate and up to date. You may ask us to correct or remove any information you believe is inaccurate or outdated.

      • request the deletion of personal data

In certain circumstances, you have the right to request the deletion of your personal data — for example, when the data is no longer needed for the purpose for which it was collected, when you withdraw consent (if the processing is based on consent), or when you believe the data is being processed unlawfully.

      • request the restriction of processing

You have the right to request the restriction of processing of your personal data in the following cases:

      • if you contest the accuracy of the data, for the period during which Navis Marine verifies its accuracy,
      • if the processing is unlawful, but you do not wish the data to be deleted and instead request restriction of use,
      • if Navis Marine no longer needs the data, but you require it for establishing, exercising, or defending legal claims,
      • if you have objected to the processing, pending verification of whether the legitimate interests of Navis Marine override your interests.
      • object to the way we use your data

You have the right to object to the processing of your personal data that is based on the legitimate interests of Navis Marine, including profiling, or if the data is processed for direct marketing purposes.

      • request the transfer of your data to another data controller (right to data portability)

You have the right to receive your personal data that you have provided to Navis Marine in a structured, commonly used, and machine-readable format, and to transfer it to another data controller if technically feasible, where the processing is based on consent or a contract, or is carried out by automated means.

To exercise any of the rights listed above, please use the contact details provided at the beginning of this Privacy Policy. Please note that these rights are not absolute, and the data controller may restrict the exercise of certain rights. The reasons for limiting a right are always stated and documented.

If you believe that your rights are not being respected, you have the right to file a complaint with the competent authority — the Croatian Personal Data Protection Agency (AZOP).

When submitting an inquiry or request related to exercising any of the rights mentioned above, we may ask you to provide additional identifiers in cases where we have doubts about your identity or if you do not have verified information in our system. This is necessary to ensure that, before providing information or copies of data, we can confirm beyond doubt that the request is genuinely coming from you. For your security, we verify identity because we do not want your data to be disclosed to unauthorized third parties.

The deadline to respond to your request for exercising data subject rights is one month, and this period may be extended with prior notification and an explanation for the extension.

WHERE IS YOUR PERSONAL DATA STORED?

The personal data we collect about you is stored in a secure environment. Your personal data is protected from unauthorized access, disclosure, use, alteration, or destruction by any organization or individual.

The processed data is stored on our premises and within secure IT systems, but in some cases, we store data on the servers of our trusted service providers located within the EU.

Navis Marine ensures that personal data is kept in a secure location (which includes reasonable administrative, technical, and physical safeguards to prevent unauthorized use, access, disclosure, copying, or alteration of personal data) accessible only to authorized persons. All authorized persons sign a confidentiality declaration.

HOW LONG WILL NAVIS MARINE STORE YOUR PERSONAL DATA?

The collected data for the purposes outlined in this Policy will be stored only for as long as necessary to fulfil those purposes. Your personal data will not be kept in a form that enables your identification longer than Navis Marine reasonably considers necessary to achieve the purpose for which the data was collected or processed, or longer than required by applicable regulations obliging Navis Marine to retain certain data.

If you have provided consent (for example, by selecting a certain category of cookies), we will process your personal data until you withdraw your consent.

If you submit a justified objection to the processing of personal data based on legitimate interest, we will cease processing your personal data going forward.

In addition, it is important to note that if judicial, administrative, or extrajudicial proceedings are initiated, personal data may be retained until the conclusion of such proceedings, including any possible periods for filing legal remedies.

For example, data related to the exercise of your privacy rights will be stored for 5 years. You can obtain more detailed information regarding retention periods by contacting our Data Protection Officer.

FOR WHAT PURPOSES DO WE USE YOUR DATA?

We may use your personal data in several different ways, primarily to fulfil our legal and other obligations toward you, but also to improve your user experience on the website and for security reasons.

The purposes for which we use your data are described in this Policy, and if your data is to be processed for any additional purposes, you will be informed before such new processing begins.

      COOKIES

To maintain our website and ensure that its functionalities operate at the expected level, Navis Marine uses technology known as “cookies.”

Cookies are small files we send to your device and may later access. They may be temporary or persistent. Thanks to cookies, you can browse our website without difficulty. Cookies show us what interests you and other visitors, which helps us improve the website.

DOES NAVIS MARINE SHARE PERSONAL DATA WITH THIRD PARTIES?

The protection of your privacy is important to us, and therefore we will never share your personal data with third parties except for the purposes described in this Policy. You will always be informed about data sharing and transfers.

Navis Marine cooperates with other companies. This means that we may occasionally share your personal data using secure IT systems. When doing so, data may be transferred to servers located in the EU or in a country that ensures an adequate level of protection in accordance with EU law, using appropriate safeguards.

Examples of purposes for sharing data with our trusted partners include marketing activities, maintaining our website, providing IT services, legal consulting, and similar. These service providers are obligated, under relevant agreements, to process the data entrusted to them only in accordance with our instructions and exclusively for the purpose we have strictly defined. We also require them to adequately protect your data and treat it as a business secret.

Once a year, we conduct an audit of all our partners to ensure that the protection of your personal data remains at the required level and complies with applicable regulations.

On the website navis-marine.com, Navis Marine, as the controller of personal data, has integrated components of Facebook. Facebook is a social network that allows users to create private profiles, upload photos, and connect through friend requests. Facebook is owned by Meta Platforms Inc., 1 Hacker Way, Menlo Park, CA 94025, USA.

When accessing navis-marine.com, the browser of the data subject automatically displays the corresponding Facebook component due to the integration of Facebook plugins. A list of all Facebook plugins can be found at: https://developers.facebook.com/docs/plugins/. During this technical process, Facebook receives information about the specific subpage visited by the data subject.

If the data subject is logged into Facebook at the same time, Facebook can detect each visit to the navis-marine.com website. This information is collected via the Facebook component and associated with the user’s Facebook account. If the user clicks on any Facebook button integrated on navis-marine.com, such as the “Like” button, or submits a comment, Facebook associates this information with the user’s Facebook account and stores the personal data.

Each time a data subject is logged into Facebook while accessing navis-marine.com, Facebook receives this information via the Facebook component, regardless of whether the user interacts with the Facebook component or not. Data Protection Officer Contact: https://help.x.com/en/forms/privacy

Navis Marine has integrated components of the X service into the navis-marine.com website.
X is a multilingual, publicly accessible microblogging service where users can publish and share so-called “tweets,” short messages limited to 280 characters. These messages are visible to everyone, including users who are not logged into X. Tweets are displayed to the user’s followers—other X users who subscribe to their content. X also allows communication to a broader audience through hashtags, links, and retweets.

Whenever a user accesses navis-marine.com—a website that contains an integrated X component (X button)—the user’s browser automatically loads the X component. During this technical process, X receives information about the specific subpage visited. The purpose of integrating the X component is to enable the sharing of navis-marine.com content, inform users about our website, and increase visitor traffic.

If a user clicks on any X button on the website, the information is transferred to the user’s X account and stored as personal data.

X receives this information via the X component as long as the user is logged into X during the website visit, regardless of interaction with the X button. If the user does not want such data transfer, they must log out of their X account before accessing navis-marine.com.
